Failure of limitation defence to a contribution claim due to absence of binding payment agreement - RG Carter Building Ltd v Kier Business Services Ltd

Clarification as to when time will start running under s. 10 Limitation Act 1980 in respect of contribution claims following settlement.
A contribution claim under the Civil Liability (Contribution) Act 1978 must be brought within two years of settlement or judgment. In RG Carter Building Ltd v Kier Business Services Ltd, the court construed the wording s.10(4) of the Limitation Act 1980, making it clear that that time starts to run only from the date of a binding payment agreement, and not from the date of any earlier agreement in principle.
