Time for a change - The German Insolvency Law Reform
The German legislator has passed the Law for the Further Facilitation of the Restructuring of Enterprises (Gesetz zur weiteren Erleichterung der Sanierung von Unternehmen, ESUG). ESUG will come into force on 01 March 2012.
Please join us for a seminar which will provide insight into the key improvements of German insolvency proceedings implemented by ESUG including:
- strengthening creditors’ influence on key decisions;
- improving insolvency plan proceedings, in particular by including rules on debt-equity swaps;
- facilitating self-administration; and
- introducing a new early restructuring procedure.
Regina Rath from our Frankfurt office will guide you through the new regime and will explain why German in-court restructurings will become more attractive.
