Mit Urteil vom 11.12.2018 (Az. KZR 26/17) hat der Bundesgerichtshof (BGH) für Schadensersatzklagen potentieller Geschädigter von Quoten- und Kundenschutzkartellen der bis dato geltenden Praxis pauschaler Anscheinsbeweise ein Ende gesetzt. Ein solcher Anscheinsbeweis wurde bisweilen bezüglich (i) der konkreten Kartellbefangenheit sowie (ii) der Entstehung eines Schadens hinsichtlich der von den Abnehmern getätigten Erwerbsvorgänge verwendet.
