The Regulation replaces securitisation provisions in, among other things, the Alternative Investment Fund Managers Directive (AIFMD).   • Cross-border marketing of AIFs and UCITS - European Commission proposes rule changes

    ​The European Commission has published proposals to change a number of the rules governing the cross-border distribution of alternative investment funds and undertakings for collective investment in transferable securities. The proposed introduction of rules on pre-marketing of funds, in particular, may result in some (presumably, unintended) difficulties for EU alternative investment fund managers (AIFMs) - this will need to be watched carefully as the proposals are considered by the Council of the EU and the European Parliament.

  • Luxembourg: new circular on access to tax residence certificates for funds (including RAIFs)

    In a positive move for the local fund industry, Luxembourg has clarified that tax residence certificates for the purposes of double tax treaties are available to reserved alternative investment funds (RAIFs) not investing in risk capital.
