Withholding taxes took another battering in the European Court of Justice in Aberdeen Property Fininvest Alpha Oy (ECJ, 18 June 2009). In a decision which will be welcomed by investment funds throughout the EU and their investors, the ECJ has ruled that Finland breached EU law by imposing withholding tax on dividends paid to non resident parent companies, whilst exempting Finnish resident parent companies and investment funds.
