Confidential, quicker and cheaper dispute resolution: arbitration

Stuart Dutson and Alex Sussman published an article in the Alternative Investment Management Association (AIMA) Journal – Edition 115, setting out the benefits for asset managers of using arbitration to resolve their disputes.

According to a recent survey by the International Chamber of Commerce, the asset management industry rarely use arbitration to resolve disputes, even though arbitration has the potential to be, in many cases, a superior alternative to court proceedings.

Some potential advantages include:

  • being able to choose and set your own rules of the procedure instead of being bound by the court rules of procedure
  • confidentiality
  • limited disclosure
  • an expedited procedure
  • arbitration awards are often easier to enforce out of jurisdiction than English courts judgments.
