24 September 2016 deadline to protect your EU trade mark portfolio.
You have until 24 September 2016 to file “Article 28” declarations at the EU trade mark office. Otherwise certain of your pre-June 2012 EU trade marks will be deemed to protect only the goods and services covered by the “literal meaning” of the relevant Nice class headings.
Many brand owners have already filed their declarations to protect the scope of their EU trade mark portfolios, but the six month window for such declarations will close in just a few weeks. At that point, the scope of the goods and services of some of the marks in those portfolios will be permanently curtailed and trade mark rights lost.
