  • PS19/16: High-Cost Credit Review: Overdraft policy statement

    On 18 December 2018 the UK Financial Conduct Authority (FCA) proposed significant reform to the overdraft market in its consultation paper CP18/42, “High-Cost Credit Review: Overdrafts consultation paper and policy statement” (the CP). This contained customer-centric proposals aimed at distributing overdraft charges more fairly and protecting vulnerable customers.

  • EBA publishes Opinion on the elements of strong customer authentication under PSD2

    On 21 June 2019, the European Banking Authority (EBA) published an opinion responding to concerns about market preparedness for the coming into force of strong customer authentication (SCA) requirements under PSD2 on 14 September this year, and questions on which authentication processes the EBA would consider to be compliant. The opinion also sets out its views on what constitutes a compliant SCA element under PSD2.

  • FCA publishes first annual report on its regulatory perimeter, and Treasury Committee responds

    The ECJ has, in providing guidance on the correct method for attributing residual VAT to hire purchase transactions, rejected the Advocate General’s suggestion that a hire purchase transaction should be treated as a single taxable supply for VAT purposes.

  • Credit provider subsidy did not reduce consideration for underlying supply of goods

    The consideration for a supply of goods by a retailer was the full agreed price, even where the retailer received a lower amount pursuant to a credit arrangements agreed between it and the credit provider.
